These Terms of Service ("Terms") are a contract between you and ZIGGYCOW LLC, a South Carolina limited liability company doing business as SizeKit ("SizeKit," "we," "us"), governing your use of the SizeKit service. By creating an account or using SizeKit, you agree to these Terms and to our Privacy Policy. Please read Section 12 (Arbitration & Class-Action Waiver) — it affects how disputes are resolved and requires individual arbitration.
SizeKit lets nail artists ("Artists") size clients ("Clients") remotely. An Artist sends a Client a private scan link; the Client uses their phone camera and a reference coin to scan their nails; SizeKit converts the scan into nail measurements and size codes, which appear in the Artist's dashboard. Artists can convert measurements to brand/shape/length options, keep customer records, notes, and tags, and optionally connect Shopify or open a SizeKit Storefront.
Related terms: Clients using a scan link are covered by the Client Scan Terms. If you open a storefront, the Storefront Seller Terms also apply to you, and your buyers' orders are governed by the Terms of Sale. If a supplemental document conflicts with these Terms on its subject, the supplemental document controls.
You must be at least 18 and able to form a binding contract to hold an Artist account. You are responsible for your account, your login credentials, and all activity under your account. Authentication is provided through Clerk; you also agree to any applicable provider terms.
When you invite a Client to scan, you represent that you have a genuine sizing relationship with that person and a lawful basis to invite them. You agree not to:
You are responsible for honoring your own Clients' requests about their data and for complying with the laws that apply to your business. As between you and SizeKit, you and SizeKit each act as an independent controller of the personal data each determines the purposes for.
Your records are yours. As an Artist, you own and control the customer records you build in SizeKit (customers, measurements, notes, tags). You can access, export, and delete them as described in the Privacy Policy.
License to us: you grant SizeKit a license to host, process, and use data through SizeKit as needed to provide and improve the service, consistent with the Privacy Policy — including delivering sizing, retaining scans for your reference, training our models on scan images only where the person scanned has given the separate opt-in consent described in the Privacy Policy, and using anonymized measurement data.
You agree not to: reverse engineer or scrape the service; interfere with its operation or security; upload unlawful, infringing, or harmful content; resell or provide the service to third parties except to size your own Clients; or use SizeKit to violate any law.
If you upload images (for example, nail-art inspiration), you represent that you have the rights to do so, and you grant SizeKit a license to host and display that content to operate the service. We respond to valid copyright notices under the DMCA; send notices to thesizekit@gmail.com (our designated agent). We may remove content and terminate repeat infringers.
SizeKit produces estimates to help with nail sizing. We aim for high accuracy but do not guarantee that any measurement, size, or recommendation will be correct or that a product will fit. You are responsible for your own purchasing and application decisions.
We may modify, suspend, or discontinue features at any time. We aim for good availability but do not guarantee uninterrupted service. The scan flow is the core of the product and we work to keep it reliable.
The service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law.
To the fullest extent permitted by law, SizeKit will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the event giving rise to the claim.
These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the service will be resolved by binding individual arbitration seated in South Carolina, rather than in court, except that either party may bring a claim in small-claims court or seek injunctive relief for misuse of intellectual property. Disputes will be brought only in an individual capacity, not as a plaintiff or class member in any class or representative proceeding. If any part of this Section is unenforceable, the rest remains in effect; if the class-action waiver is unenforceable for a particular claim, that claim proceeds in court.
We may suspend or terminate your access for violation of these Terms or to protect the service. On termination, the data-retention and deletion terms of the Privacy Policy apply (including the six-month grace period after account closure).
We may update these Terms. Material changes take effect on a new effective date, and for existing Artists we will ask you to review and accept the updated Terms before continuing to use the dashboard. Continued use after an update means you accept the revised Terms.
