Copyright & DMCA Policy
Effective date: September 23, 2026 (Version 1.0)
SizeKit is operated by ZIGGYCOW LLC ("SizeKit," "we," "us"). Nail artists use SizeKit to run storefronts and upload photos and inspiration images. Artists are responsible for what they upload, and our Terms of Service and Storefront Seller Terms prohibit content and listings that infringe anyone's copyright or trademark — for example, designs copied from someone else's artwork, or unlicensed characters, logos, or franchise branding. We respect intellectual property rights and respond to notices of infringement under the Digital Millennium Copyright Act (17 U.S.C. § 512).
1. Our designated agent
Send copyright infringement notices and counter-notices to our designated agent, registered with the U.S. Copyright Office:
Roy James
ZIGGYCOW LLC (doing business as SizeKit)
348 Belle Lindler Rd, Gilbert, SC 29054
Phone: (803) 543-4620
Email: ziggycowweblabs@gmail.com
Email is the fastest way to reach us. This contact is only for intellectual-property complaints; other messages sent here may not get a reply.
2. How to report copyright infringement
If you believe content on SizeKit infringes a copyright you own or are authorized to enforce, send our agent a written notice that includes:
- Your physical or electronic signature (typing your full legal name is fine)
- A description of the copyrighted work you believe is infringed (or, if several, a representative list)
- The link (URL) to each listing, image, or page you want removed, so we can find it
- Your name, mailing address, phone number, and email address
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner's behalf
A notice missing these details may not be valid, and we may ask you to complete it. Under 17 U.S.C. § 512(f), anyone who knowingly misrepresents that material is infringing may be liable for damages. Consider whether the use may be a fair use before sending a notice.
3. What happens after a valid notice
We act promptly. When we receive a valid notice, we remove or disable access to the reported content, let the artist who posted it know, and send them a copy of the notice (which may include your name and contact details, so they can resolve it with you directly). We record the notice against the artist's account for our repeat-infringer policy.
4. Counter-notices (for artists)
If your content was removed and you believe it was a mistake or misidentification — for example, it is your own original design, or you have a license — you can send our agent a counter-notice that includes:
- Your physical or electronic signature
- A description of the content that was removed and where it appeared before removal (the listing link is ideal)
- A statement, under penalty of perjury, that you have a good faith belief the content was removed as a result of mistake or misidentification
- Your name, address, and phone number
- A statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located (or, if you are outside the United States, any judicial district in which SizeKit may be found), and that you will accept service of process from the person who sent the original notice or their agent
We forward valid counter-notices to the person who sent the original notice. Unless they tell us within 10 business days that they have filed a court action to stop the infringement, we may restore the content between 10 and 14 business days after we receive the counter-notice. Only send a counter-notice if you are confident the content does not infringe — the same misrepresentation penalties apply.
5. Repeat infringers
We terminate, in appropriate circumstances, the accounts and storefronts of artists who repeatedly infringe. As a rule, an artist who receives three valid infringement notices (counted per notice, not per item) that are not successfully countered will have their storefront closed and may lose access to SizeKit. We may act sooner for clear or deliberate infringement, such as selling counterfeit branded products.
6. Trademark and other IP complaints
The DMCA covers copyright only. If a listing uses your trademark — for example, a brand, franchise, or character name used without permission — email ziggycowweblabs@gmail.com with your contact details, the trademark and its registration number (if any), the link to each listing, and why you believe the use is unauthorized. We review these reports and remove listings that violate our terms.
7. Changes
We may update this policy. The current version is always on this page. Questions about this policy can go to the same address: ziggycowweblabs@gmail.com.
